This Privacy Notice is provided by Revian Inc. (“Revian,” “we,” or “us”) and describes the personal information we collect, how we use it and with whom we share it with respect to the use of the Revian website (the “Site”), user dashboards, our mobile applications and admin portals (the “Services”).

Updates To This Notice

We may update this Privacy Notice based upon evolving laws, regulations, and industry standards, or as we may make changes to our Services. We will post changes to our Privacy Notice on this page or in the appropriate section of our mobile application and encourage you to review our Privacy Notice when you use our Services to stay informed. If we make changes that materially alter your privacy rights, we will take appropriate measures to inform you, consistent with the significance of the changes we make. If you disagree with the changes to this Privacy Notice, you should discontinue your use of our Services.

Third Party Links

The Services may contain hyperlinks to other unaffiliated websites that may have information policies and practices different from ours. We have no control over those websites, are not responsible for their privacy policies, practices or content, and this Privacy Notice does not apply to them.

Children’s Information

We do not knowingly collect any personal information from individuals under 18 years of age. If we learn that we have collected the personal information of an individual under 18, we will delete the information as soon as possible.

Information Collection, Use, and Sharing

“Personal Information” means information that alone or when used in combination with other information may be used to readily identify, or contact you. Personal Information does not include anonymized or de-identified information. The data we collect depends on how you interact with our Services.

Information You Provide Us

You may provide us with your Personal Information when you email us, when you enter your name, address, phone number and email address into our contact forms or when you register for an account, or when you submit a question or survey to us within the Services.

Device and Treatment Information

When you register and use a Revian product, Revian may automatically collect information regarding your use of the product, including treatment dates and treatment frequency. Revian may use this information to provide and support Revian products and Services, calculate treatment compliance, administer product programs and warranties, improve our products and Services, and for other purposes described in this Privacy Notice.

Revian collects and generates this information as part of its direct relationship with you, and not on behalf of any Participating Affiliate (defined below). Device and treatment information is collected only from Revian products that connect to our mobile application, such as the REVIAN RED System. The REVIAN LYTE cap does not connect to our mobile application, and we do not collect treatment information from it.

Information We Receive from Participating Affiliates

We may receive information about you from a Participating Affiliate (defined below), such as the referral code you used, records of your purchase of a Revian product from that Participating Affiliate, your requests under a Revian money back guarantee, and information about product complaints or adverse events you report to that Participating Affiliate. We use this information to process orders, track referrals, administer product programs and warranties, handle product complaints, field actions and recalls, and for the other purposes described in this Privacy Notice. Participating Affiliates will not provide medical records, diagnoses, treatment plans, insurance information or other clinical information to Revian.

Information We Automatically Collect

When you use our Services, we may automatically collect certain information about your device and how you interact with our Services, including your web browser, IP address, time zone, and browsing activity, through cookies and similar technologies. Additionally, as you browse the Services, we may collect information about the individual web pages and services that you view, what websites or search terms referred you to the Services, and information about how you interact with the Services. We may automatically collect this information using the following technologies:

How We Use Your Personal Information

We use the personal information we collect from you in the following ways:

Sharing your Personal Information

We disclose your personal information:

To our third-party service providers, to facilitate services they provide to us. These can include providers of services such as data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, user support service, email delivery, auditing, and other services;
To companies we work with in order to provide you with any services you have requested from us;
When your account is associated with a Participating Affiliate, to Participating Affiliates, as described in “Information Shared with Participating Affiliates” below; and
To comply with applicable laws, regulations, respond to subpoenas, search warrants or other lawful request for information we receive, or to otherwise protect our rights.

We may disclose your personal information as part of a corporate business transaction such as a merger or acquisition, divestiture, sale of Revian assets, or in the event of insolvency, bankruptcy, or receivership. In these cases, personal information could be transferred to third parties as a business asset. We may offer financing options through third-party financing providers. If you select one of these options, you may be required to provide information directly to the financing provider, subject to its own privacy practices. We will not sell or rent your Personal Information. We disclose Personal Information only as described in this Privacy Notice.

Information Shared with Participating Affiliates

If you purchase or receive a Revian product through, are referred to Revian by, or otherwise associate your Revian Account with a participating Revian affiliate, reseller, referral partner or other authorized commercial partner (a “Participating Affiliate”), Revian may make certain information available to that Participating Affiliate to support your use of Revian products. This information may include your first name, last name, email address, and treatment-related information such as your first treatment date, most recent treatment date and treatment compliance percentage (“Treatment Adherence Information”).

This information is provided directly by you to Revian or is collected or generated by Revian through your registration and use of Revian products and Services. By associating your Device or Account with a Participating Affiliate and using the Services, you authorize Revian to make this information, including your Treatment Adherence Information, available to that Participating Affiliate.

Participating Affiliates access this information through a Revian portal (the “Affiliate Portal”). The Affiliate Portal makes available only the information listed above. First treatment date, most recent treatment date and treatment compliance percentage are available only for Revian products that connect to our mobile application, such as the REVIAN RED System.

Once such information has been provided to a Participating Affiliate, that Participating Affiliate is responsible for its subsequent use, maintenance, disclosure and protection in accordance with laws applicable to that Participating Affiliate.

You may withdraw your authorization at any time by creating a support ticket at https://revian.com/support/. Withdrawal applies prospectively and does not affect information made available to a Participating Affiliate before your request is processed.

Security

We use administrative, technical, and organizational safeguards designed to protect your Personal Information against unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like in customer reviews.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

How To Opt Out Of Email Communications

If you provide us with your email address, we may send you product emails from time to time. If you do not wish to receive such emails from us, you may opt out of future emails regarding that product by following the opt-out instructions in the email. Note that you cannot opt out of receiving required administrative or legal communications. Opt-out requests will be effective after a reasonable period of time for processing but in no event longer than such time as may be required by applicable law.

California Civil Code Section 1798.83 permits Users of our Services that are California residents to request certain information regarding our disclosure of the information you provide through the Services to third parties for their direct marketing purposes.
