Revian Terms of Sale

Definitions:

These Terms of Sale apply to the purchase and sale of products and services from the Company, including those purchased through https://revian.com. In these Terms of Sale, “Seller”, and “Company” means Revian, Inc.; “Buyer” means the person, firm, company or corporation who places the order, “Device” means the REVIAN RED System or REVIAN LYTE cap, as applicable, “User” means the person who actually uses the Device. These Terms of Sale are considered a part of the Terms of Service that apply generally to the use of our services. 

Shipping:

The Seller will make every reasonable effort to ship all orders within one (1) day of receipt. Typically orders ship the same business day if received by 3pm Eastern time. If free shipping is offered, the Seller will select the most economical shipping option that allows for tracking, delivery confirmation, and insurance.

If an item ordered is out of stock or the order cannot be processed and/or shipped for any reason, Buyer will be notified via email or phone within one (1) business day of the Seller’s receipt of the order.

Transit time for Ground / Home Delivery and free shipping options vary from one (1) business day to seven (7) to ten (10) days depending on the delivery address. Shipments originate from central North Carolina. If express shipping (e.g. Overnight or 2-Day) is selected, transit times are in accordance with the transportation service provider’s quoted delivery for the selected shipping method.

Title of the Device passes from Seller to the Buyer when the shipment is tendered to the transportation service provider.

Currently, the Device is only available for sale in the United States and orders cannot ship to addresses outside of the United States.

REVIAN RED 100% Money Back Guarantee:

For the REVIAN RED System, Seller offers a Money Back Guarantee to its initial Buyers. In order to qualify for this Money Back Guarantee the User must have a minimum of 80% treatment compliance as reported within their User dashboard during their first six months (180 days) (the “Money Back Guarantee Period”) and request to return the Device within the 7th month (day 180 – day 210) after the date of first treatment. If the User is not fully satisfied with their results, the Buyer must notify the Seller that they wish to return the Device by submitting a customer support ticket through the Revian website. The Seller will review the User’s information to ensure the User was a minimum of 80% compliant with the recommended treatment regimen.  If User was compliant with the recommended treatment regimen, the Seller will then provide a Return Merchandise Authorization (the “RMA”) number. The Buyer will be responsible for shipping the Device back to the Seller with the RMA number, and the Device must be postmarked for return within fourteen (14) days. Once the Device has been received, the Seller will process a refund made to the form of payment the Buyer used to pay for the purchase.  If User was not compliant with the recommended treatment regimen, the Seller may, at its sole discretion, refuse to refund the payment to the Buyer.

REVIAN LYTE Guarantee:

For REVIAN LYTE, Seller offers a Sixty Percent (60%) Money Back Guarantee to its initial Buyers. In order to qualify for this Sixty Percent Money Back Guarantee the User must request to return the Device between the 12th (twelfth) month after the date of purchase and the end of the 13th (thirteenth) month after the date of purchase. If the User is not fully satisfied with their results, the Buyer must notify the Seller that they wish to return the Device by submitting a customer support ticket through the REVIAN website and provide proof of purchase to Revian.  Seller will then provide a Return Merchandise Authorization (the “RMA”) number. The Buyer will be responsible for shipping the Device back to the Seller with the RMA number, and the Device must be postmarked for return within fourteen (14) days. Once the Device has been received, the Seller will process a refund of sixty percent (60%) of the original purchase price made to the form of payment the Buyer used to pay for the purchase.  

Order Returns and Exchanges:

As a medical device, no returns or exchanges are permitted of any Device that has been used or in a package that has been opened.

If Buyer wishes to return a new, unopened, never used Device in the original undamaged packaging within 10 days of purchase, they should contact Seller at https://www.revian.com/support to submit a return request. All returns must be authorized by Seller prior to receipt. Once a return is authorized, Seller will issue a Return Merchandise Authorization (the “RMA”) number and provide instructions on how to return the Device. A refund, net of shipping costs, will be made to the form of payment Buyer used to pay for the purchase. Failure to comply with the instructions on how to return the Device could result in delays in processing and potentially refusal of the refund.

Limited Warranty:

Devices purchased from unauthorized sellers may be counterfeit, defective, or not meet the same quality standards as products purchased directly from us or through our authorized sellers. As such, Revian cannot offer any warranty or guarantee for Devices purchased from unauthorized sellers. Purchases from such sellers are at the buyer’s own risk, and any claims related to these Devices, including warranty claims, will not be honored.

Revian does not warrant that the operation of the Device will be error-free or uninterrupted. The User is responsible for the proper maintenance and handling of the Device.  No warranty is extended to any Device that has been altered, physically damaged or modified in any way. The limited warranties below do not cover problems caused by User acts (or failures to act) including, but not limited to improper use or maintenance of the Device, the acts of others, or event(s) beyond the reasonable control of Revian.  

REVIAN RED Limited Warranty:

The REVIAN RED Limited Warranty covers against defects in materials or workmanship from date of purchase with proof of purchase. If a REVIAN RED System is determined to be defective within three (3) years from date of purchase, Revian will, at its option, repair, or replace with a like model, free of charge. After three (3) years from date of purchase, Revian will repair a REVIAN RED System determined to be defective for a charge dependent on the scope of the repair, or replace a REVIAN RED System for a charge equal to 25% of current MSRP, plus shipping and handling. Revian reserves the right to decide whether a repair or replacement will be offered for a defective REVIAN RED System.

REVIAN LYTE Limited Warranty:

The REVIAN LYTE Limited Warranty covers against defects in materials or workmanship from date of purchase with proof of purchase. If a REVIAN LYTE cap is determined to be defective within twelve (12) months from date of purchase, Revian will repair, or replace with a like model, free of charge. After twelve (12) months from date of purchase, Revian will repair a REVIAN LYTE cap determined to be defective for a charge dependent on the scope of the repair, or replace a REVIAN LYTE cap for a charge equal to 50% of current MSRP, plus shipping and handling. Revian reserves the right to decide whether a repair or replacement will be offered for a defective REVIAN LYTE cap.

THE COMPANY MAKES NO OTHER WARRANTIES FOR THE DEVICE.

Force Majeure:

Company will not be liable or responsible, nor be deemed to have defaulted or breached these Terms of Sale, for any failure or delay in our performance under these Term of Sale when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency,  revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

No Waivers:

The failure by Company to enforce any right or provision of these Terms of Sale will not constitute a waiver of future enforcement of that right or provision. A waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Revian.

Previous Terms of Sale:

Purchases of Devices made on or before December 7, 2020 are subject to an older version of the Terms of Sale available HERE.

Purchases of Devices made after December 7, 2020 but on or before November 4, 2024 are subject to an older version of the Terms of Sale available HERE

Purchases of Revian Red system made on and after November 4, 2024 will receive the benefit of the limited warranty in these Terms of Sale.
